LCL Confidentiality of Patron and Library Records Policy

PURPOSE:  

The purpose of this policy is to establish the Library’s responsibility in making every reasonable and responsible effort to see that information about patron and individual choices remain confidential. Therefore, the Library has adopted the following guidelines concerning the disclosure of information about Library patrons. 

 

The Library will not share the following: 

  1. a patron’s name (or whether an individual is a registered borrower or has been a patron) 
  2. a patron’s contact information, to include, addresses, phone numbers and email addresses
  3. the Library’s circulation records and their contents 
  4. the Library’s borrower records and their contents 
  5. the number or character of questions asked by patrons 
  6. the frequency or content of a patron’s visits to the Library 
  7. computer use records 
  8. or any other information supplied to the Library, or gathered by it shall be given, made available or disclosed to any individual, corporation, institution, or government agency without a valid process, order or subpoena. 

Upon presentation of a valid process, a court order or subpoena, the Library shall resist its enforcement until such time as a proper showing of good cause has been made in a court of competent jurisdiction. The Library Director shall contact the Northeast Kansas Library System, administrators of the Integrated Library System, once the subpoena has been presented.

It is this confidence that is vital to the Library’s role in the community and the community’s right to know, pursuant to Kansas Public Records Law, K.S.A. 45-215 et. seq. 

Parents or legal guardians are permitted access to the records of their minor children through the age of 17.
